Payment Policy

Due to limited availability at each retreat, we require a non-refundable hold deposit of $500 to reserve a space at the retreat.

Full payment for the retreat is due within 6 weeks of the start date.

Refunds:

1. If you cancel within 31-60 days or more before the retreat start date, you forfeit 50% of your payment (less deposit).

2. If you cancel within 30 days or less of the retreat start date, you forfeit your entire payment. 

​

If you cancel (or postpone) your booked retreat date, Luna Light does not offer refunds for any reason. A portion of your payment, or deposit payment, may be used as credit for another retreat date and package; and must be taken within 1 year of your original retreat date. We will gladly transfer your credit to the name another person upon your arrangement of that transfer.

We strongly recommend that you purchase Travel & Cancellation Insurance. With most agencies, insurance must be purchased within 7 days of making your reservation.

Please be sure that your insurance policy covers you for all relevant SPORT ACTIVITIES that you will be engaging in on your trip and TRIP CANCELLATION. Depending on the policy and conditions, travel cancellation insurance will pay for some or all cancellation fees. You are welcome to choose any international travel insurance provider.

LIABILITY WAIVER & ASSUMPTION OF THE RISK

IMPORTANT NOTICE: PLEASE CAREFULLY READ THE FOLLOWING AGREEMENT.  IT IS A BINDING LEGAL AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS.

BY ACCEPTING IT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, RELEASING LUNA LIGHT YOGA, LLC FROM POTENTIAL CLAIMS AND LIABILITY, AND ARE AGREEING TO REIMBURSE LUNA LIGHT YOGA, LLC IF IT INCURS FEES AND COSTS ARISING FROM CERTAIN ACTS OR OMMISSIONS BY YOU.

In consideration for being permitted to participate in a Luna Light Yoga, LLC yoga retreat and associated events and activities (collectively, “the Retreat”) and the services of Luna Light Yoga, LLC, its agents, owners, officers, volunteers, participants, employees, sponsors, and all other persons or entities acting in any capacity on its behalf, as well as its successor and assigns (collectively, “LLY”), I, the participant listed on the registration form, hereby acknowledge and agree to the following (the “Waiver”):

Health Representation.  I am mentally and physically sound and suffering from no physical or mental impairment, illness, or other infirmity that would prevent my participation in the Retreat or endanger myself or others while participating in the Retreat.  I represent I have either had a physical examination and been given my physician’s permission to participate, or that I have decided to participate, in the Retreat without the approval of my physician and do hereby assume all responsibility from said participation.

Location Representation. I further represent that I have conducted satisfactory due diligence into the location where the Retreat is held.

Acknowledgement and Assumption of Risk.  I understand and acknowledge that participation in the Retreat involves many inherent risks, known and unknown, that could result in bodily injury, illness, property loss or damage, or even death as a consequence of the actions, inactions, or negligence of myself or others, and acts of God. The inherent risks of participation in the Retreat, include but are not limited to: 

Risks inherent in yoga activities, including without limitation: minor muscle strains, muscle sprains, bruises, abrasions, post-exercise muscle soreness, joint injuries, torn muscles, heat-related illnesses, broken bones, ACL injuries, back injuries, stroke, heart attack, paralysis, and death; equipment that breaks or otherwise fails, slips, and falls; and harm from negligence of yoga instructors or other yoga participants.

Risks inherent in international travel, including without limitation: road conditions; inaccessibility to immediate medical attention; terrorism; muggings; civil unrest; war; accidents; kidnapping; communicable disease; increased risk of food and water borne illness; and transportation, medical care, and structures that are not operated or maintained to standards found in the United States of America.  I acknowledge and agree that LLY is not responsible for providing any security services while on the Retreat.

Risks presented by nature, including without limitation: insect, snake, and animal bites and stings; encounters with wildlife; weather conditions; conditions in the water including tides, rip tides, animals, my own ability to swim; and natural disasters.

General health risks, including without limitation: illness; disease; known and unknown health conditions; allergies; motion sickness; dehydration; heat stroke; stroke; and heart attack.

Risk due to the COVID-19 pandemic, including without limitation: risk of exposure to or  infection by COVID-19 which could result in serious and permanent illness, injury, or death; increased risk of travel delays and cancellations; and required quarantines. 

I acknowledge and understand that the risks arising from participation in the Retreat are inherent and LLY cannot eliminate, alter, or control these inherent risks.

MY PARTICIPATION IN THE RETREAT IS VOLUNTARY AND THAT I EXPRESSLY AND KNOWINGLY ASSUME ALL KNOWN AND UNKNOWN RISKS, INCLUDING BUT NOT LIMITED TO THOSE RISKS IDENTIFIED ABOVE, EVEN IF ARISING FROM THE NEGLIGENCE OF LLY.

Release of Liability.  For myself and on behalf of my heirs, assigns, personal representative(s), and estate, I hereby voluntarily release and forever discharge LLY from any and all liability, claims, demands, actions, or rights of action which are related to, arise out of, or are in any way connected with my participation in the Retreat, including specifically but not limited to the negligent acts or omissions of LLY, for any and all injury, death, illness or disease, or damage to myself or my property.

On behalf of myself, my heirs, assigns, personal representative(s), and estate, agree not to sue, assert, or otherwise maintain or assert any claim against LLY for any injury, death, illness, disease, or damage to me or my property arising from or connected with my participation in the Retreat unless caused by LLY’s gross negligence.

I UNDERSTAND THAT THIS AGREEMENT DISCHARGES LLY FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST LLY WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM MY INVOLVEMENT IN A RETREAT, WHETHER CAUSED BY THE NEGLIGENCE OF LLY, OR OTHERWISE.

I also understand that LLY does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

I understand that this is the entire agreement between LLY and me and that it cannot be modified or changed in any way by the representations or statements of any employee or agent of LLY, or by me.

Indemnification. I, individually and on behalf of my heirs, successors, assigns, and personal representatives, hereby agree to indemnify and hold harmless LLY for any damages, liabilities, losses, penalties, fines, charges, or expenses of any nature whatsoever which arise out of, occur during, or are in any way connected with your participation in the Retreat.

Medical Treatment.  I acknowledge and understand that LLY is not a medical provider and will not have medical personnel available during the Retreat.

In the event that an emergency should arise and LLY determines, in its sole discretion, that I need medical care or treatment, I hereby consent for LLY to obtain or provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel.  I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment.  

I also hereby release and forever discharge LLY from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or other medical services rendered to me or obtained on my behalf in connection with an emergency during the Retreat.  

Entire Agreement and Severability.  This Agreement is the full, final, complete and exclusive agreement of the parties with respect to the subject matter of this Agreement. It supersedes and merges all prior agreements and discussions between the Parties. This Agreement is intended to be as broad and inclusive as permitted by Tennessee law.

In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.  

Choice of Laws and Forum. This document shall be governed by the laws of the State of Tennessee, without giving effect to any conflict-of-laws principles that require application of the law of a different jurisdiction. 

Any dispute between the parties arising out of or relating in any way to this Agreement shall be brought exclusively in the state and federal courts of Williamson County, Tennessee and the parties waive any right to challenge jurisdiction or venue in said courts.

Electronic Signatures. This Agreement may be electronically signed and electronic signatures shall have the same force and effect as an original signature.

BY ELECTRONICALLY CHECKING THE BOX INDICATING THAT I HAVE READ, ACCEPT, AND AGREE TO THIS AGREEMENT, I UNDERSTAND THAT I AM ENTERING INTO A BINDING LEGAL AGREEMENT THAT SHALL HAVE THE SAME EFFECT AS IF I SIGNED THIS AGREEMENT BY HAND.  

I HEREBY ACKNOWLEDGE AND ACCEPT ALL THE TERMS AND CONDITIONS ABOVE AND REPRESENT THAT I HAVE READ THE ENTIRE DOCUMENT, UNDERSTAND IT COMPLETELY, AND VOLUNTARILY AGREE TO BE BOUND BY ITS TERMS.
